i think that it matters in which way you want to use this program. i would prefer using 3dsmax for creating abstract things and maya for "real" modelling, for example modelling a human face etc.
all in all i would say both programs do need a specific amount of skill to use it properly, but in my opinions i think that maya is in some cases harder to use.
